Eat Drink Etc respects the intellectual property rights of others. We expect our users to do the same. This policy describes our approach to handling copyright infringement claims under the Digital Millennium Copyright Act (“DMCA”).

Our website features various articles, recipes, images, and other creative content. We are committed to protecting the rights of copyright holders and will respond to valid notices of alleged copyright infringement.

How to File a DMCA Takedown Notice

If you believe that content published on eat-drink-etc.com infringes your copyright, please send a written notification to our designated DMCA Agent. Your notice must include all of the following information to be valid:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification Process

If your content was removed due to a copyright infringement claim and you believe this was an error, you may submit a counter-notification. This counter-notification must include specific information.

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which eat-drink-etc.com may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we may send a copy of it to the original complaining party. We will inform that person that we will replace the removed material or cease disabling access to it in 10 business days unless they notify our DMCA Agent that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity related to the material.

Repeat Infringer Policy

Eat Drink Etc maintains a policy of terminating user accounts or blocking access for individuals who are repeat infringers of copyright. We will take appropriate action against users who repeatedly post or transmit infringing material.

We may, in our sole discretion, limit access to our website and services and/or terminate the accounts of any users who infringe any intellectual property rights of others, regardless of whether there is any repeat infringement.
